Reaching out to my network to share some exciting new policies issued by USCIS (the federal immigration agency). This new policy could be extremely important for folks living in the U.S. who do not have Lawful Permanent Residence or Citizenship.The government will now make it easier for certain people who entered the U.S. without a visa to obtain a Green Card (aka Lawful Permanent Residence).Here is a simplified outline of the criteria:1️⃣ Presence in the US: You must be here without admission or parole.2️⃣ Length of Stay: A minimum of 10 years of continuous presence in the US as of June 17, 2024.3️⃣ Marital Status: You must be legally married to a US citizen as of June 17, 2024.4️⃣ Clean Record: No disqualifying criminal history and no threat to national security or public safety.5️⃣ Positive Merits: Finally, your overall case must merit a favorable exercise of discretion.Please DM me if you or anyone in your network needs assistance obtaining legal immigration status in the U.S.!ATTORNEY ADVERTISING: Prior results do not guarantee future outcomes.

It concerns US immigration law and potential aid and assistance for Ukrainians.The US government published this helpful information (US Citizenship and Immigration Service):The following measures may be available on a case-by-case basis upon request:-Changing a nonimmigrant status or extending a nonimmigrant stay for an individual currently in the United States. If you fail to apply for the extension or change before expiration of your authorized period of admission, we may excuse that if the delay was due to extraordinary circ*mstances beyond your control;-Re-parole of individuals previously granted parole by USCIS;-Expedited processing of advance parole requests;-Expedited adjudication of requests for off-campus employment authorization for F-1 students experiencing severe economic hardship;-Expedited adjudication of petitions or applications, including employment authorization applications, when appropriate; -Consideration of fee waiver requests due to an inability to pay; -Flexibility for those who received a Request for Evidence or a Notice of Intent to Deny but were unable to submit evidence or otherwise respond in a timely manner; -Flexibility if you were unable to appear for a scheduled interview with USCIS;-Expedited replacement of lost or damaged immigration or travel documents issued by USCIS, such as a Permanent Resident Card (Green Card), Employment Authorization Document, or Form I-94, Arrival/Departure Record; and-Rescheduling a biometric services appointment.If you would like additional information, please do not hesitate to contact me.718-806-1312

    Now is a good time for employers and employees interested in the H-1B visa to reach out to their attorneys regarding the application process. In 2020, USCIS revised the H-1B process so that potential H-1B employees could enter the H-1B lottery by simply registering their name with a few personal details. This change makes the H-1B process much less costly. Potential employees can sign up for the lottery with a mere $10 registration fee and know if they are selected. In the past, H-1B applicants generally had to prepare a complete application before entering the lottery system.In FY 2022, employees were able to create registration accounts as early as February 24, 2021.     TRAVEL BAN LIFTED STARTING NOVEMBER 8, 2021To those affected by the country-specific COVID-19 travel bans implemented by the U.S. government, please take note of the following:- the White House has issued a proclamation making changes affecting both noncitizens and those with permanent status (US citizens and Green Card holders);- the proclamation suspends the entry of unvaccinated noncitizens except in limited circ*mstances;- those traveling by air who are fully vaccinated, including citizens and Green Card holders, will be required to provide i) a negative PCR test within 3 days before the flight into the U.S. or proof of recovery AND ii) proof of an approved COVID-19 vaccine;- all non-immigrants who are not fully vaccinated will NOT be permitted entry into the U.S. except for extremely limited circ*mstances.#travel #covid #immigration #visa #tourism

    The United States Citizenship recently passed regulations that could make it much easier for foreign nationals to reside in the United States. Specifically, the countries of Venezuela and Burma (Myanmar) have been added to the list of TPS. Certain time restrictions apply. TPS (Temporary Protected Status) is a program that allows foreign nationals to remain in the United States even if they do not have a valid visa. Under the current regulations, DHS may designate a foreign country for TPS due to conditions in the country that temporarily prevent the country's nationals from returning safely, or in certain circ*mstances, where the country is unable to handle the return of its nationals adequately. During a designated period, individuals who are TPS beneficiaries:· Are not removable from the United States· Can obtain an employment authorization document (EAD)· May be granted travel authorizationIf you know of anyone from the following countries, please contact an immigration attorney to obtain further information: Burma (Registration period: March 11, 2021 - September 7, 2021), El Salvador, Haiti, Honduras, Nepal, Nicaragua, Somalia, Sudan, South Sudan, Syria, Venezuela (Registration period: March 9, 2021 – Sept. 5, 2021), Yemen.
